Cyberwarfare : a new era of waging war

Abstract

As the technological world continues to evolve, so does the type of infrastructures management a nation has, since they are more connected via computer systems. In doing so, if one wants to wage war against a nation, instead of starting by destroying its essential structures by deploying several resources, this can be done by a “simple” cyberattack of its infrastructures’ systems – which can be done remotely. These types of attacks can cause significant damage to a nation’s vital systems and be compared directly with the ones sustained by an actual kinetic attack. This dissertation will focus on the evolution of Cyberwarfare and its impact on society. Considering those are very modern and recent concerns, it is important to understand which laws and regulations on cyberwarfare and cybercrime exist in the international context. Even though there are multiple laws and regulations related to cyberspace, until now there is no specific legislation dedicated to Cyberwarfare.

À medida que a tecnologia continua a evoluir, a gestão das infraestruturas de uma nação também se desenvolve, uma vez que estão cada vez mais interligadas através de sistemas informáticos. Assim, em vez de destruir as estruturas essenciais de uma nação com recursos físicos, é possível realizar um ”simples” ciberataque aos sistemas das suas infraestruturas - de forma remota. Estes ataques podem causar danos significativos aos sistemas vitais de uma nação, podendo ser comparados aos provocados por um ataque físico direto. Neste trabalho, será abordada a evolução da Ciberguerra e o seu impacto na sociedade. Dado que são preocupações bastante atuais e recentes, é fundamental compreender as leis e regulamentos referentes à ciberguerra e cibercrime num contexto internacional. Ainda que existam múltiplas leis e regulamentações relacionadas ao ciberespaço, até agora não há uma legislação específica dedicada à Ciberguerra.
